How do you sell a Dubai property while living abroad?
Through a special power of attorney held by someone in Dubai. The Land Department's digital sale channel needs a UAE ID, so your attorney signs for you.

Through a special power of attorney. The Land Department's digital sale channel is open only to holders of a UAE ID (Dubai Land Department, 3 Sep 2026), so an owner abroad appoints someone in Dubai to sign the sale contract, obtain the developer's NOC and attend the transfer, while a licensed broker markets the property under Form A. The proceeds are issued in the owner's name, not the attorney's (Bayut, 7 Sep 2026).
Key facts
- The Dubai Now digital sale "is provided for individuals that only holds UAE ID" (Dubai Land Department, 3 Sep 2026).
- A power of attorney issued abroad takes around 7 to 12 working days to attest (Property Finder, 29 Apr 2026) and is valid for two years from notarisation (Bayut, 7 Sep 2026).
- The Form F deposit is typically 10 per cent; a clean sale takes several weeks to a few months (Property Finder, 20 Aug 2026).
How does the power of attorney work?
Make it special, not general: a special power of attorney "clearly defines the authorised property and actions, unlike a general POA" (Bayut, 7 Sep 2026). It names you, the attorney and the unit, grants authority to sell and to represent you before the Land Department, the developer and the bank, and states how long it runs (Bayut, 7 Sep 2026). We advise having the draft reviewed in Dubai before notarisation; a fault found later means restarting the chain.
The chain runs from a notary in your country to your ministry of foreign affairs, then the UAE embassy, then in the UAE the Ministry of Foreign Affairs stamp and "a certified Arabic translation from a translator licensed by the UAE Ministry of Justice" (Bayut, 7 Sep 2026). From the UK that means a UK notary, the UAE Embassy in London and attestation in the UAE (Property Finder, 8 Dec 2025).
| Step | Where | Time | Cost |
|---|---|---|---|
| Notarise | Notary in your country | Same day to 2 working days | About AED 100 per signature |
| Legalise | Your foreign ministry, then the UAE embassy | Embassy dependent | Ask the mission |
| Attest | UAE Ministry of Foreign Affairs | 1 to 3 working days | About AED 150 |
| Translate | Ministry of Justice licensed translator | Not published | AED 50 to 300 or more per page |
Timings and fees are Property Finder's, 29 Apr 2026; the whole chain runs to around 7 to 12 working days.
On validity, Bayut reports Land Department guidance that a power of attorney for sale, mortgage and grant transactions "is valid for two years from the date of notarisation unless otherwise restricted by applicable requirements" (Bayut, 7 Sep 2026). Confirm the current requirement with the registration trustee before relying on an older instrument, and ask a Dubai notary or lawyer whether remote execution is possible; we do not assume it is.
How do you get a valuation from abroad?
From data, not from a visit. Agents' appraisals are free and rest on "recent comparable sales, current demand, agent expertise"; ask each agent "to explain their reasoning with reference to specific comparable sales" (Property Finder, 20 Aug 2026). A formal RERA-approved valuation is paid for and takes several days to two weeks (Property Finder, 20 Aug 2026). Betterhomes says its valuations draw on 250,000 or more transactions and a database of 1.7 million or more buyers, investors and renters (Betterhomes, 2026).
Dubai REST gives owners "the current prices of their properties, rental return, service charges", and the Rental Index is open to all (Dubai Land Department, 3 Sep 2026). Our own valuation for a seller abroad uses the same Land Department data and the live listings in the building, and the comparables travel with the figure.
How do the listing and reporting work?
The listing starts with Form A, the RERA-approved agreement that "formalizes the agent relationship and authorizes property marketing" (Property Finder, 20 Aug 2026). Up to three brokers may hold one at once, and every joint owner signs (Bayut, 21 Oct 2025). No advert appears without a Trakheesi permit, which needs the marketing contract with the owner, costs AED 1,000 plus AED 20 and issues in one working day (Dubai Land Department, 3 Sep 2026). The broker then handles photography, portal promotion, viewings, feedback after each viewing, offers and the transfer (Property Finder, 20 Aug 2026).
No published source fixes how often a broker should report, so we state our own practice. Every seller who lists with Davies+Harrison gets access to their private Seller Module within D+H Invest: weekly listing performance (portal impressions, enquiries, viewings, offers), documents and adviser commentary. Updated every Monday.
How do the sale contract and deposit work?
Form F "sets out the agreed purchase price, the transfer date, the deposit amount (typically 10% of the purchase price), and any conditions of the sale" (Property Finder, 20 Aug 2026). It becomes a valid contract only once seller and buyer have both signed, witnessed and dated by the agent (Bayut, 21 Oct 2025). From abroad, "the authorised POA representative signs the DLD Form F on seller's behalf" (Bayut, 7 Sep 2026). The deposit is held against the transaction (Property Finder, 20 Aug 2026); what happens to it if either side withdraws is set by the terms written into Form F, so we advise stating the completion date and the default terms in plain words.
How does the transfer happen without you?
Your attorney "applies for a No Objection Certificate (NOC) after ensuring all service charges have been cleared", and gathers the developer NOC, the Mollak service charge clearance and any mortgage discharge letter (Bayut, 7 Sep 2026). The NOC costs AED 500 to 5,000 and takes two to three working days (Property Finder, 1 Apr 2026). If mortgaged, the bank's liability letter sets the figure settled at transfer (Dubai Land Department, 3 Sep 2026).
At the trustee's office your attorney brings the signed Form F, the "physically attested POA with MOFA stamp and certified Arabic translation", identification and the buyer's manager's cheque made out to you (Bayut, 7 Sep 2026). The appointment takes about 25 minutes (Dubai Land Department, 3 Sep 2026) and the title deed issues the same day (Property Finder, 20 Aug 2026).
The money follows the title, not the attorney: proceeds are issued "usually in the name of the registered property owner", by manager's cheque (Bayut, 7 Sep 2026). You need a UAE account in your own name, or a bank able to clear the cheque, and paperwork showing the purpose and source of funds for the outbound transfer (Property Finder, 8 Dec 2025).
What does it cost?
| Item | Amount | Source |
|---|---|---|
| DLD transfer fee | 2 per cent each side in law; the buyer usually pays all 4 per cent | Dubai Land Department, 3 Sep 2026; Property Finder, 3 Jul 2026 |
| Developer NOC | AED 500 to 5,000 | Property Finder, 1 Apr 2026 |
| Agency commission | Usually 2 to 3 per cent plus VAT, by agreement, typically the seller's | Property Finder, 23 Jun 2026 |
| Mortgage release | AED 1,290 plus AED 315; early settlement capped at 1 per cent or AED 10,000 | Dubai Land Department, 3 Sep 2026; Bayut, 7 Sep 2023 |
| Power of attorney | Notary about AED 100 per signature; attestation about AED 150; translation AED 50 to 300 or more per page | Property Finder, 29 Apr 2026 |
The trustee's fee, AED 2,000 or AED 4,000 plus VAT by the AED 500,000 threshold, falls by convention to the buyer (Dubai Land Department, 3 Sep 2026; Property Finder, 3 Jul 2026).
Will you be taxed at home?
Not in the UAE: there is no personal income tax (u.ae, 2026), and a residential resale is exempt from VAT (Federal Tax Authority, 2026). If you are UK resident, "you pay Capital Gains Tax when you 'dispose of' overseas property"; relief may be available if taxed twice, and "non-residents may have to pay UK tax on overseas property if they return to the UK within 5 years of leaving" (HM Revenue and Customs, 2026). Elsewhere, take advice in your country of tax residence.
Our view
In our experience the sale from abroad fails on paperwork, not on price. We advise three things: start the special power of attorney first, since every later step depends on it; confirm the account that will receive a manager's cheque in your own name, since the attorney cannot receive it; and obtain the service charge statement and, if mortgaged, the liability letter before listing.
We also advise choosing a broker for what it will show you: the comparables behind the valuation, and how often you will hear about viewings and offers. A seller abroad should never have to ask twice.

No. It "is provided for individuals that only holds UAE ID" and UAE Pass signatures (Dubai Land Department, 3 Sep 2026; Bayut, 7 Sep 2026). A title transfer instead accepts "an official power of attorney from the owner", with passport copies for non-residents (Dubai Land Department, 3 Sep 2026).
The document must identify the representative and set out what they may do (Bayut, 7 Sep 2026); they attend the developer, the bank and the trustee office in person. In our experience owners choose a relative, a lawyer or a conveyancer.
Two years from notarisation for sale, mortgage and grant transactions, unless otherwise restricted (Bayut, 7 Sep 2026). Confirm with the trustee before relying on an older instrument.
Not usually. Proceeds are issued "in the name of the registered property owner", by manager's cheque (Bayut, 7 Sep 2026), and the Land Department's own cheque split for a mortgaged sale puts the balance in the seller's name (Dubai Land Department, 3 Sep 2026).
The bank issues a liability letter and the debt is settled by manager's cheque at transfer; the release costs AED 1,290 plus AED 315 (Dubai Land Department, 3 Sep 2026). The Central Bank has capped the early settlement charge since 2019 at 1 per cent of the balance or AED 10,000, whichever is lower (Bayut, 7 Sep 2023).
