Terms of Use
1. Introduction and Acceptance
These Terms of Use (“Terms”) govern your access to and use of the website at daviesandharrison.com (the “Site”) and the Davies & Harrison investment platform (the “Platform”), both operated by DAH Real Estate Brokerage L.L.C., trading as Davies & Harrison (“we”, “us”, “our”), a RERA-licensed real estate brokerage registered in Dubai, United Arab Emirates.
By accessing or using the Site or the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site or the Platform.
We may update these Terms from time to time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Site or Platform after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
2. About Davies & Harrison
Davies & Harrison is a licensed real estate brokerage registered with the Real Estate Regulatory Agency (RERA) and the Dubai Land Department (DLD). Our RERA broker registration number is 53447 and our DED trade licence number is 1532907.
Our registered office is at API World Tower, Sheikh Zayed Road, Dubai, UAE.
2.1 Nature of Our Services
Davies & Harrison acts as a real estate brokerage intermediary. We connect prospective buyers and investors with property developers and facilitate off-plan property transactions in Dubai.
Important: Davies & Harrison is not a financial advisor, investment advisor, fund manager, or regulated financial services firm. We do not provide financial, investment, tax, or legal advice. The information presented on our Site and Platform is for general informational purposes only and should not be relied upon as the basis for any investment decision. You should seek independent professional advice before making any property investment.
3. Eligibility
By using the Site and the Platform, you represent and warrant that:
You are at least 18 years of age and have the legal capacity to enter into binding agreements in your jurisdiction of residence;
You are accessing the Site and Platform for lawful purposes only;
All information you provide to us (including through forms, email, WhatsApp, or the Platform) is accurate, current, and complete;
You are not prohibited from using our services under any applicable law, regulation, or sanctions programme.
4. The Site
4.1 Informational Content
The Site provides information about off-plan property developments in Dubai, including property descriptions, indicative pricing, payment plans, developer details, area guides, and market insights. This content is provided for general informational purposes only.
While we endeavour to keep the information on the Site accurate and up to date, we do not warrant or represent that any information on the Site is complete, accurate, reliable, or current. Property prices, availability, specifications, payment plans, and handover dates are indicative and subject to change without notice. All such information should be verified directly with the relevant developer or through your Davies & Harrison advisor before making any commitment.
4.2 No Offer or Solicitation
Nothing on the Site constitutes an offer, solicitation, or recommendation to buy, sell, or invest in any property. The display of any property on the Site does not guarantee its availability or the accuracy of the information shown. Any transaction is subject to the terms and conditions of the relevant developer and the applicable laws of the United Arab Emirates.
5. The Investment Platform
5.1 Account Access
The Platform is a private portal provided to clients of Davies & Harrison. Access to the Platform is by invitation only. We create your account and provide you with login credentials (email address and password).
You are responsible for:
Maintaining the confidentiality of your login credentials;
All activity that occurs under your account;
Notifying us immediately at info@daviesandharrison.com if you become aware of any unauthorised use of your account or any security breach.
We are not liable for any loss or damage arising from your failure to safeguard your login credentials. We recommend that you change your password upon first login and use a strong, unique password.
5.2 Platform Content
The Platform may provide access to property details, transaction documents, portfolio information, and other materials related to your property investments. All content on the Platform is provided for informational purposes and is subject to the same disclaimers set out in Section 4.1 and Section 10 of these Terms.
5.3 Account Suspension and Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if:
You breach any provision of these Terms;
We reasonably suspect unauthorised or fraudulent activity on your account;
We are required to do so by law, regulation, or a competent authority;
We discontinue the Platform or any part of it.
Upon termination, your right to access the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 6, 7, 10, 11, 12, and 13) will continue in force.
6. Intellectual Property
6.1 Our Content
All content on the Site and Platform — including text, images, photographs, graphics, logos, icons, brochures, floor plans, renders, video content, data compilations, software, and the overall design and layout — is the property of DAH Real Estate Brokerage L.L.C. or its licensors and is protected by applicable intellectual property laws, including UAE Federal Decree-Law No. 38 of 2021 (on Copyrights and Neighbouring Rights) and international copyright conventions.
The Davies & Harrison name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or those of our licensors. You may not use these marks without our prior written permission.
6.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Platform for personal, non-commercial purposes in connection with exploring our services. This licence does not include:
Reproducing, distributing, or publicly displaying any content from the Site or Platform;
Using any content for commercial purposes, including reselling, republishing, or creating derivative works;
Scraping, data mining, or using automated tools to extract content from the Site or Platform;
Framing or embedding any part of the Site or Platform on another website or application.
6.3 Developer Content
Some content on the Site (including property renders, floor plans, developer brochures, and project descriptions) is provided by or on behalf of third-party property developers. This content remains the intellectual property of the respective developers. We display it under licence or with permission for the purposes of promoting those developments. You may not reproduce or distribute developer content without the permission of the relevant developer.
7. Acceptable Use
You agree not to use the Site or Platform in any way that:
Is unlawful, fraudulent, or harmful;
Violates the rights of any third party, including intellectual property, privacy, or publicity rights;
Introduces viruses, malware, or other harmful code;
Attempts to gain unauthorised access to any part of the Site, Platform, or our systems;
Interferes with or disrupts the integrity or performance of the Site or Platform;
Impersonates any person or entity, or falsely represents your affiliation with any person or entity;
Submits false, misleading, or inaccurate information through any form or communication channel;
Uses the Site or Platform for any purpose that is competitive with Davies & Harrison’s business.
We reserve the right to investigate and take appropriate action (including suspending or terminating your access) if we reasonably believe you have violated these provisions.
8. Forms, Inquiries, and Communications
The Site contains forms that allow you to submit inquiries, register interest in specific properties, and request resources (such as the Dubai Investment Guide). By submitting a form, you:
Consent to us processing your personal data as described in our Privacy Policy;
Acknowledge that our team may contact you by email, phone, or WhatsApp to respond to your inquiry;
Confirm that the information you provide is accurate.
Submitting an inquiry form does not create a contractual obligation on either party to proceed with any transaction. It is an expression of interest only.
Marketing communications: We will only send you marketing communications (including property alerts, newsletters, and promotional offers) if you have separately opted in by ticking the marketing consent checkbox on our forms. You may withdraw your consent at any time by using the unsubscribe link in any marketing email or by contacting us at privacy@daviesandharrison.com. For full details, see our Privacy Policy.
9. Third-Party Links and Content
The Site may contain links to third-party websites, including property developer websites, social media platforms, and external service providers. These links are provided for your convenience and do not imply endorsement, sponsorship, or affiliation.
We have no control over the content, privacy practices, or availability of third-party websites and accept no responsibility or liability for them. Your use of any third-party website is at your own risk and subject to that website’s terms and conditions.
Where the Site embeds third-party content or tools (such as newsletter signup forms or messaging widgets), the third party’s own terms and privacy policy may also apply to your interaction with that content.
10. Disclaimers
10.1 General Disclaimer
The Site and Platform are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site or Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the content will be accurate or complete.
10.2 Investment Disclaimer
Davies & Harrison is a licensed real estate brokerage. We are not a financial advisor, investment advisor, or regulated financial services provider.
The information on the Site and Platform, including property descriptions, pricing, payment plans, projected handover dates, area information, and market commentary, is provided for general informational purposes only. It does not constitute and should not be construed as:
Financial, investment, tax, or legal advice;
A recommendation or solicitation to buy, sell, or invest in any property;
A guarantee of future returns, capital appreciation, or rental income;
A representation that any investment is risk-free.
Property values may fluctuate. Past performance is not indicative of future results. You may not recover the full amount of your investment. You should seek independent financial, legal, and tax advice before making any property investment decision.
10.3 Pricing and Availability
All property prices, payment plans, specifications, and availability shown on the Site or Platform are indicative only and are subject to change without notice. These figures are provided by or derived from information supplied by property developers and are not independently verified by Davies & Harrison unless expressly stated. You should not rely on any pricing or availability information on the Site without obtaining direct confirmation from your Davies & Harrison advisor or the relevant developer.
10.4 Projected Returns
Where the Site or Platform displays projected rental yields, returns on investment, capital appreciation estimates, or similar forward-looking information, these are estimates only and are not guaranteed. Actual results may differ materially from any projections. Such projections are based on assumptions that may prove to be incorrect.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
Davies & Harrison, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of (or inability to use) the Site or Platform, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or relating to these Terms, the Site, or the Platform shall not exceed the amount of one thousand United States dollars (USD 1,000), or the equivalent in AED.
We shall not be liable for any loss or damage arising from: (i) your reliance on any information provided on the Site or Platform; (ii) any investment decision you make based on content displayed on the Site or Platform; (iii) any third-party actions, products, or services; (iv) any interruption, suspension, or termination of the Site or Platform; or (v) any unauthorised access to or alteration of your data or account.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Davies & Harrison, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Your use of the Site or Platform;
Your breach of these Terms;
Your violation of any applicable law or regulation;
Your infringement of any intellectual property or other rights of any third party;
Any information you submit through the Site or Platform that is inaccurate, misleading, or incomplete.
13. Anti-Money Laundering and Customer Due Diligence
Davies & Harrison is classified as a Designated Non-Financial Business or Profession (DNFBP) under UAE Federal Decree-Law No. 20 of 2018 (as amended) and is subject to anti-money laundering (AML), counter-terrorism financing (CTF), and sanctions compliance obligations.
In connection with any property transaction, we may be required to:
Verify your identity and the identity of any beneficial owners;
Obtain evidence of the source of funds being used for the transaction;
Screen your details against applicable sanctions lists and politically exposed persons (PEP) databases;
Retain records of identification and transaction data for a minimum of five (5) years after the end of the business relationship, as required by law.
You agree to cooperate fully with our due diligence processes and to provide accurate, complete, and current information and documentation when requested. Failure to provide satisfactory identification or source of funds documentation may result in our inability to proceed with a transaction.
We may be required to report suspicious transactions to the UAE Financial Intelligence Unit (FIU). We are prohibited by law from informing you if such a report is made.
14. Privacy
Your use of the Site and Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal data. By using the Site or Platform, you acknowledge that you have read and understood our Privacy Policy.

15. Cookies

16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.
Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates.
GDPR acknowledgement: Notwithstanding the governing law clause above, if you are located in the European Economic Area (EEA) or the United Kingdom (UK), nothing in these Terms affects your rights under the EU General Data Protection Regulation (GDPR) or the UK GDPR. Our processing of your personal data is governed by our Privacy Policy and applicable data protection law.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.
18. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
19. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Davies & Harrison regarding your use of the Site and Platform. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter hereof.
For the avoidance of doubt, these Terms govern your use of the Site and Platform only. Any property transaction between you and a developer (facilitated by Davies & Harrison) will be governed by a separate agreement between the relevant parties.
