How do Dubai off-plan payment plans work?

A booking payment, instalments tied to construction and a balance at handover, sometimes beyond it. Miss one and the Land Department serves 30 days' notice.

A Dubai off-plan payment plan is the schedule in your sale and purchase agreement: a booking payment, 20 per cent under Emaar's terms (Emaar, 2026), construction-linked instalments and a balance at completion, sometimes spread over years after handover (Bayut, 26 Aug 2026). Every payment sits in a project escrow account (Dubai Land Department, Law 8 of 2007). Miss an instalment and the Land Department serves a 30-day notice before the developer may terminate (Dubai Land Department, 2018).

Key facts

  • Booking: Emaar asks 20 per cent at purchase (Emaar, 2026); Binghatti Aquarise takes 20 per cent on booking, 50 during construction and 30 at completion (Binghatti, 2026).
  • Post-handover plans run three to five years, occasionally ten (Bayut, 26 Aug 2026), with up to 60 per cent of the price due after the keys (Property Finder, 30 Jun 2026).
  • Default: a 30-day Land Department notice, then termination without a court order and retention of up to 40 per cent of the price on a project over 60 per cent complete (Dubai Land Department, 2018).

What is a payment plan made of?

Three parts, each set by the developer in the sale and purchase agreement (SPA). The booking payment secures the unit; Emaar's published programme terms ask for 20 per cent at purchase, or a higher percentage at its discretion (Emaar, 2026). Construction-linked instalments fall due on dates or milestones, which Ellington says "will vary from project to project" (Ellington Properties, 2026).

Khaleej Times reported in January 2026 that developers are moving from long post-handover schedules to construction-linked ones, and quoted brokers describing monthly plans as low as 0.25 per cent and 70/30 and 80/20 splits as the emerging standard (Khaleej Times, 19 Jan 2026).

What does post-handover mean?

Part of the price is paid in instalments after you receive the keys: up to 60 per cent in the projects Property Finder lists (Property Finder, 30 Jun 2026), over three to five years and occasionally ten. Pantheon Elysee in Jumeirah Village Circle took 30 per cent before handover and 70 per cent over ten years (Bayut, 26 Aug 2026).

No title deed is issued in your name until the last instalment is paid, and developers commonly restrict leasing until then (Gulf News, 9 Apr 2019). Read the leasing clause before you rely on rent to fund the instalments.

How are my instalments protected?

By Law No. 8 of 2007. A developer selling off-plan must open an escrow account through the Land Department, and every purchaser payment goes to the escrow agent (Dubai Land Department, Law 8 of 2007). The account is in the project's name, dedicated exclusively to that project's construction, and cannot be attached by the developer's creditors (Dubai Land Department, Law 8 of 2007).

Depositors "may gain access to their own accounting records"; 5 per cent of each account is held for a year after completion; and if a project is not completed the agent must act to protect depositors (Dubai Land Department, Law 8 of 2007). The Department publishes each project's completion percentage through its free Project Status Enquiry (Dubai Land Department, 2026).

What fees sit around the plan?

The developer must register the sale on the Interim Real Property Register through Oqood within 90 days of signing; an unregistered off-plan sale is void (Dubai Land Department, Law 13 of 2008; Dubai Land Department, 2026). The Land Department fee is 2 per cent of the sale value from each side, plus AED 10 knowledge and AED 10 innovation fees and AED 1,000 for the developer's registration (Dubai Land Department, 2026). In practice the buyer carries the full 4 per cent (Emaar, 2026), plus a registration trustee fee of AED 2,000 or 4,000 plus VAT (Betterhomes, 28 Mar 2026).

Ellington requires the down payment, Oqood and registration charges cleared before it issues the SPA (Ellington Properties, 2026). A 20 per cent booking payment plus the 4 per cent Land Department fee puts 24 per cent of the price on the table at the outset.

What happens if I miss an instalment?

The sequence is set by Article 11 of Law No. 13 of 2008 as replaced by Law No. 19 of 2017. The developer notifies the Land Department, which verifies the claim, serves a 30-day written notice on you and attempts mediation during the period (Dubai Land Department, 2018). If you have not paid when it expires, the developer may act without a court order; what it may do depends on the project's progress (Dubai Land Department, 2018):

Project completionDeveloper may
Over 80%Keep the contract and claim the balance, request a public auction, or terminate and retain up to 40% of the price
60% to 80%Terminate and retain up to 40% of the price
Under 60%, work startedTerminate and retain up to 25% of the price
Not started, for reasons beyond the developer's controlTerminate and retain up to 30% of the amounts paid, refunding the rest within 60 days

In the first three cases any excess is refunded within one year of termination or 60 days of resale, whichever is earlier (Dubai Land Department, 2018). If RERA cancels the project, every payment is refunded under Law No. 8 of 2007 (Dubai Land Department, 2018).

Within this frame, Emaar charges interest from the date of default (Emaar, 2026). Nakheel issues a Notice of Default giving 30 days, after which ownership is terminated on the Land Department's approval (Nakheel, 2026). Ellington gives 30 days' notice, then acts under the SPA and Dubai property law (Ellington Properties, 2026).

Can a plan be paused, restructured or assigned?

Not as of right. Nakheel says the schedule cannot be amended, but "payment extensions can be requested, subject to approval from the leadership team" (Nakheel, 2026). Ask early, in writing, before a date is missed.

Assignment is the usual exit. Units on the interim register may be sold or mortgaged (Dubai Land Department, Law 13 of 2008), once the developer's threshold is met: 50 per cent paid for Emaar's programme units (Emaar, 2026); 30 per cent on most Ellington projects, 50 on ten named ones, with AED 5,250 for the NOC and SPA transfer (Ellington Properties, 2026); Nakheel's NOC costs AED 500 plus VAT and is valid 30 days (Nakheel, 2026). On the transfer the developer may charge only Land Department-approved administrative costs (Dubai Land Department, Law 13 of 2008).

Will a bank lend on an off-plan unit?

Up to half. The Central Bank caps the loan-to-value ratio on off-plan purchases at 50 per cent "regardless of purpose, value, or category of purchaser", against 80 per cent for an expatriate's first completed home under AED 5 million (Central Bank of the UAE, Circular 31/2013). Off-plan mortgages are in practice limited to tier-one developers' projects (Betterhomes, 28 Mar 2026).

How do I follow the plan from abroad?

The Project Status Enquiry gives the completion percentage immediately, through the Land Department website, the Dubai REST app or WhatsApp on 8004488, and is open to non-residents (Dubai Land Department, 2026). Dubai REST also shows the escrow account number and the payments due on projects you hold (Dubai Land Department, 2026).

Our view

In our experience the plan matters more than the headline discount. A small booking payment and a long post-handover tail look generous, but they defer the title deed and may restrict letting. A construction-linked plan with the balance at completion is simpler to fund and simpler to exit.

To see what a plan means for your own capital, model the instalments against the build period and the handover date in our free investment calculator.

We advise reading the SPA payment clause before signing, and holding the Oqood and Land Department money as well as the booking payment on day one. Match each milestone instalment to the completion percentage the Land Department publishes. Keep one instalment in reserve, and if a payment will be late, ask for an extension in writing before the date.

Frequently Asked Questions

A developer-set schedule in the SPA: a booking payment, instalments during construction, a payment at completion and sometimes instalments after handover. Ellington's standard plan is 50 per cent during construction and 50 on completion (Ellington Properties, 2026).

Part of the price, up to 60 per cent in listed projects, is paid in instalments after you receive the keys (Property Finder, 30 Jun 2026), over three to five years, occasionally ten (Bayut, 26 Aug 2026). The title deed follows the final payment (Gulf News, 9 Apr 2019).

Yes, where the SPA provides for it. Emaar charges interest from the date of default (Emaar, 2026); Nakheel and Ellington refer to penalties under the SPA (Nakheel, 2026; Ellington Properties, 2026).

The UAE levies no income tax on individuals (u.ae, 2026). The first supply of a new home within three years of completion is zero-rated for VAT (Ministry of Finance, 8 Sep 2026), and unlicensed real estate investment by an individual is excluded from corporate tax (Federal Tax Authority, Oct 2024).

If RERA cancels the project, all payments are refunded from the escrow account (Dubai Land Department, 2018; Dubai Land Department, Law 8 of 2007). On delay the SPA governs; the Land Department may conciliate, a settlement binds both sides, and damages are for the courts (Khaleej Times, 8 Dec 2024).
