Can you sell an off-plan property in Dubai before handover?
Yes, once the developer issues a no-objection certificate and the sale is registered with the Dubai Land Department. Here is what it costs and who pays.

Yes. An off-plan property in Dubai can be sold before handover once the developer issues a no-objection certificate and the sale is registered on the Dubai Land Department's interim register; an unregistered sale is void (Dubai Land Department, Law 13 of 2008). Most developers require 30 to 40 per cent paid first (Property Finder, 23 Jun 2026). The buyer takes over the remaining instalments and, by convention, pays the 4 per cent transfer fee (Bayut, 24 Sep 2025).
Key facts
- Minimum paid before a resale: usually 30 to 40 per cent, set by your sale and purchase agreement (Property Finder, 23 Jun 2026; Bayut, 24 Sep 2025).
- Developer NOC: AED 500 to 5,000, issued in two to three working days through Dubai REST (Property Finder, 1 Apr 2026).
- DLD transfer fee on the resale price: 4 per cent plus AED 20 in fixed fees; registration trustee AED 5,000 plus VAT (Dubai Land Department, 2026).
- Tax on the gain for an individual: none, and a residential resale is exempt from VAT (u.ae, 2026; Ministry of Finance, 7 Sep 2026).
What makes an off-plan resale valid?
Two things: the developer's consent and the Land Department's register. Under Law No. 13 of 2008 every off-plan sale must be entered in the Interim Real Property Register, and an unregistered sale has no legal effect (Dubai Land Department, Law 13 of 2008). The same law limits what a developer may charge on a resale to DLD-approved administrative costs (Dubai Land Department, Law 13 of 2008, Art. 7); percentage "assignment fees" quoted in some broker material have no basis in it.
Your developer registered the original purchase through the Oqood portal within 90 days of signing (Dubai Land Department, 2026). Selling before handover means transferring that registration to the buyer, and the Land Department lists the developer's e-NOC among the documents required at transfer (Dubai Land Department, 2026). A private side agreement moves nothing.
How much must you have paid before the developer will agree?
The threshold is contractual, not regulatory. It sits in your sale and purchase agreement and differs between developers, and sometimes between projects of the same developer. The figure that governs is the one you signed.
| Developer | Minimum paid before resale | NOC or transfer fee |
|---|---|---|
| Market norm | 30% to 40% | AED 500 to 5,000 |
| Ellington | 30%; 50% on ten named projects including Ocean House, Arbor View, One River Point, Mercer House and Art Bay | AED 5,250 covering NOC and SPA transfer |
| Emaar, Preferred Access Programme | 50%; non-transferable below that | Administrative fee, amount not stated |
| Nakheel | Not stated | AED 500 plus VAT; novation agreement; NOC valid 30 days |

Who pays what when an off-plan unit changes hands?
The Land Department's fee schedule sets the transfer fee at 2 per cent from each side (Dubai Land Department, 2026). Convention has the buyer pay the full 4 per cent on the resale price, and the seller carry the developer's NOC fee and the agency commission (Property Finder, 23 Jun 2026; Bayut, 24 Sep 2025).
| Item | Amount | Usually paid by |
|---|---|---|
| DLD transfer fee | 4% of the resale price (2% seller, 2% buyer in the DLD schedule) | Buyer, by convention |
| DLD fixed fees | AED 10 plus AED 10 | Buyer |
| Developer registration fee, where the developer re-registers the unit | AED 1,000 on the initial sale | Buyer |
| Registration trustee fee, off-plan | AED 5,000 plus VAT | Buyer |
| Developer NOC | AED 500 to 5,000 | Seller |
| Agency commission | 2% to 3% plus VAT | Seller |

How does the sale proceed?
Property Finder sets out the sequence as documents, developer NOC, marketing, negotiation, Oqood assignment and trustee transfer (Property Finder, 23 Jun 2026). In practice:
- 01 Assemble the file: SPA, proof of every instalment paid, identification, and confirmation that your paid percentage meets the SPA threshold.
- 02 Apply for the developer's NOC through Dubai REST.
- 03 Sign Form A with your broker, who obtains the Trakheesi advertising permit. You may hold up to three Form A agreements at once (Bayut, 21 Oct 2025). Advertising without the permit has drawn fines from AED 50,000 (Gulf News, 12 Aug 2022), and every advert has carried a Madmoun QR code since 24 April 2023 (Dubai Land Department, 18 Apr 2023).
- 04 Agree terms and sign Form F, the sale contract, with the buyer.
- 05 Attend a registration trustee, where the Oqood is assigned to the buyer and the fees are paid. The appointment takes around 25 minutes and the Land Department registers the sale within one business day (Dubai Land Department, 2026).
The buyer assumes the remaining instalments from transfer (Bayut, 24 Sep 2025).

Is the gain taxed?
For an individual, no. The UAE has no personal income tax (u.ae, 2026). Resale of a residential unit is exempt from VAT; only the first supply within three years of completion is zero-rated, and that is the developer's sale, not yours (Ministry of Finance, 7 Sep 2026). Corporate tax reaches individuals only above AED 1 million of business turnover, and unlicensed real estate investment income is excluded regardless of amount (Ministry of Finance, Cabinet Decision 49 of 2023); the Federal Tax Authority's guide works through an AED 400,000 gain that falls outside the tax (Federal Tax Authority, Oct 2024). Your position at home is a question for your own adviser.
What if you stop paying instead of selling?
On default the Land Department serves a 30-day notice; after that the developer may retain up to 40 per cent of the price where the project is more than 60 per cent complete, 25 per cent where it is less, and 30 per cent of the amount paid where construction has not started, refunding any excess within one year or 60 days of a resale (Dubai Land Department, 2018). De-registering the Oqood costs AED 620 and follows a one-month warning (Dubai Land Department, 2026). In our experience a resale, even at a discount, leaves a seller better placed than a forfeiture.
How active is the resale market?
Modestly. Off-plan resales were 6.1 per cent of off-plan deals in the third quarter of 2025, down from 9.7 per cent (Khaleej Times, 14 Nov 2025), and around 8 per cent in the first quarter of 2026, when developers sold some 92 per cent of off-plan units directly (Gulf News, 14 May 2026). A record 24,800 homes were delivered in the first half of 2026, 37.6 per cent more than a year earlier (Khaleej Times, 30 Jul 2026), so a resale competes with ready stock nearby.
Our view
In our experience the sellers who do well start six to twelve months before handover, the window Property Finder also suggests (Property Finder, 23 Jun 2026). Earlier, the paid percentage is often below the threshold; later, the buyer can wait for completion and buy a ready unit with a title deed.
We advise checking three things before you instruct anyone: the exact threshold in your SPA, the project's completion percentage on the Land Department's free Project Status Enquiry or Dubai REST (Dubai Land Department, 2026), and the developer's current NOC fee, which varies tenfold. Where the certificate has a fixed life, as Nakheel's 30 days does, time the application to the buyer's readiness. Price against ready stock in the same district, not against launch prices. And see Form A, the Trakheesi permit and the Madmoun QR before a photograph is published.

Frequently Asked Questions
No. The fee paid at registration is not refunded. The buyer pays 4 per cent again on the new price, and the Land Department collects it on each transfer (Property Finder, 23 Jun 2026; Bayut, 24 Sep 2025).
No primary source gives a total. The parts are known: the NOC in two to three working days (Property Finder, 1 Apr 2026), a trustee appointment of around 25 minutes, and registration within one business day (Dubai Land Department, 2026). Finding the buyer is the variable.
With the developer's approval, yes. No title deed is issued until the last instalment is paid, and the developer's consent is needed for any dealing in the unit until then (Gulf News, 9 Apr 2019). The buyer takes over the remaining schedule.
The property route requires real estate worth at least AED 2 million, held in one or more wholly owned units (Dubai Land Department, 2026; u.ae, 28 Jul 2026), and off-plan from an approved developer qualifies (Khaleej Times, 27 Jul 2025). Selling the qualifying asset removes the basis for that visa unless you hold other qualifying property. Take advice before you exchange.
Use the Land Department's free Project Status Enquiry, the Dubai REST app, or the DLD WhatsApp line on 8004488 (Dubai Land Department, 2026). Dubai REST shows the completion percentage, escrow account and payment schedule. Buyers will check the same figures, so know them first.
Payments sit in a project-specific escrow account under Law No. 8 of 2007, with 5 per cent retained for a year after completion and fines from AED 100,000 for breaches (Dubai Land Department, Law 8 of 2007). Stalled or cancelled projects fall under the Special Tribunal created by Decree No. 33 of 2020 (Dubai Land Department, Decree 33 of 2020).
